Council loses battle to force Roundhay homeowner to take down dormer
Leeds City Council has lost a battle to remove an unauthorized gable extension and rear dormer from a Roundhay home.
A planning inspector has ruled that the extensions – although done without planning permission – do not impact on the neighbourhood enough to warrant their removal.
The council issued an enforcement notice two years ago requiring the additions to No. 9 Bideford Avenue to be pulled down by June 29, 2006.
The owner appealed on the grounds that this step was excessive. After an inconclusive planning inquiry, the high court ordered a second inquiry.
The inspector concluded that both extensions were acceptable and he allowed the appeal.
